Why Not Settle?
November 5, 2024
|The battle for our community will enter its 5th year in Jan. 2025. As a reminder, Jan. 2020 is when homeowners, under the initial leadership of Jesse Miller, organized to discuss and find options for the residents of Homestead. Within 4 weeks, attorney David Andersson had outlined a plan for litigation with our representatives and incorporated our HOA, electing himself our Board of Directors. Most of us would not be aware until April 2020 when Mr. Andersson, in a letter to homeowners, admitted he had “…proactively incorporated the Homestead Owners Association, as prescribed in the CC&Rs.” Following 4 contentious, confusing years of hearings, town hall meetings, and a revolving door of defendants, we’re left with divided neighborhoods, a painfully deteriorating golf course, and no end in sight.
Over the years, Mr. Andersson and Mr. Davis turned down numerous offers to settle and today, filed an appeal which led us to question: Since they are not interested in settling for money, what do they really want??? The following is an excerpt from Mr. Andersson’s website, eb5worc.com, that offers a possible answer:
“David Andersson is the founder and President of the Whatcom Opportunities Regional Center, Inc. Mr. Andersson has been involved with the EB-5 US Immigrant Investor Program for over a decade. Currently, he is a member of the American Immigration Lawyers Association Investor (EB-5) Committee…”
At the bottom of his website is his Industry Focus:
“The U.S. retirement industry currently boasts annual revenues of more than $25 billion and has tremendous growth potential. Nearly 60 million baby boomers will reach age 65 over the next fifteen years. ‘Boomers’ are looking to retire and/or downsize while remaining active and independent.
WORC is filling the gap in the 55+ adult housing market in Whatcom County with beautiful and affordable single and multi-family homes. Together with its partner, Senior Lifestyle Services, LLC, WORC is also redefining retirement with an innovative business plan that offers assisted-living services to residents as needed.”
