On the plaintiffs website, Homestead-HOA.org, under FAQ, there is a question about those who paid $93 during the lawsuit, from Jan. 2020 to the present.  They ask if these owners will be given a credit and their reply is: “No.  Nothing in the Court Order requires the Declarant to give you a credit for your overpayment.”  

As usual, we wish the person answering questions (Mr. Davis?) would actually research before responding but fortunately, we did.  The truth is 18 Paradise hired an outside lawyer to handle refunds and collections, for the time period of June 1, 2023 to present, and if the claim is true they’re not legally obligated to provide these refunds, that says even more about their commitment to homeowners.  

Regarding overpayments from Jan. 1, 2020 to May 31, 2023, those fall under MJ Management but we have not had a chance to ask them yet. With plaintiff lawyers continuing to push back on the judge’s rulings, required hearings, and now they’ve filed an appeal, we keep having to wait for an opportunity to get answers.
