Our Plaintiff Representatives

We have been asked by so many of you who, like us, are beyond sick of this lawsuit!  The 11 plaintiffs who agreed to represent us almost 5 years ago, are the drivers of our class action.     Now that we’re past the trial and judge’s final rulings, our plaintiffs can hire a mediator to guide the negotiation process, or just communicate with the other parties, until a settlement is reached.  But they need to hear from us, their class, that we want this to be over!

Here’s how the process typically goes: When the parties reach a settlement, they submit it to the court, asking the judge to determine if it is fair, adequate and reasonable.  If it is, the court grants a preliminary approval of settlement. 

Once this is done, a notice of the settlement is sent to all class members by mail, publication, or both, outlining details of settlement, legal rights, and options to class members.

The judge will schedule a Final Fairness Hearing to hear any objections or exclusions from class members.  But if, after hearing these, the judge still believes the settlement is fair, adequate and reasonable, the settlement will be approved. Once receiving final settlement approval, benefits are distributed to class members and IT’S OVER!!!  We can breathe again, feel a sense of hope for our community’s future again, start to come together again!

WHAT EACH OF US CAN DO

Write letters to the Lynden Tribune Editor, Bill Helm, and let Lynden know how we feel about the lawsuit’s effect on our community, why it needs to be over, and that all of Lynden will feel the loss, not just Homestead, if we lose our golf course. 

Let your neighbors know on social media to please pray for all of us but especially our plaintiffs who have resisted taking the lead in ending this misery of a lawsuit.

Email or snail-mail our representatives about how you feel. They’ve had 4 years to prove their case, now it’s time to respect the judge’s decisions so we can move on. Here are their addresses; 7 live in Homestead, 4 do not, and 4 requested their addresses not be posted on our website but they should still be listed in phone book or google.

We need every voice for this final plea. The plaintiffs and our lawyers, Andersson and Davis, achieved what they wanted; dismissal of 6th & 7th amendments and lower fees. Why not take the win and let us begin the process of restoring our community, and welcoming a new owner? Instead, they want the judge to change his final rulings and filed an appeal.

As a reminder: 18 Paradise offered to settle 7 times, the Intervenors arranged a settlement with confirmed attendance by Mr. Chen (plaintiffs’ requirement), and MJ’s lawyers lost count how many times they extended to settle – ALL were declined by plaintiffs’ lawyers. This is not a representation of our best interests, but theirs!
